Country music superstars Tim McGraw and Faith Hill‘s duet “The Rest Of Our Life,” which was written by Steve McCutcheon, Johnny McDaid, Ed Sheeran and Amy Wadge, has become the subject of a copyright lawsuit. According to The Hollywood Reporter, the new suit was filed in New York on Wednesday by Sean Carey and Beau Golden who claim the song is a ripoff of their tune “When I Found You.” Their song was a hit 2014 for recording artist Jasmine Rae in Australia. The lawsuit names Tim McGraw, Faith Hill, Ed Sheeran, Johnny McDaid, Steve McCutcheon, Amy Wadge, and their respective publishing companies/ record labels as defendants.
The legal document itself states that “the copying is, in many instances, verbatim, note-for-note copying of original elements of the Song, and is obvious to the ordinary observer.” The pair of songwriters are asking for at least $5 million in damages as well as profits, royalty costs, and a repayment of all attorney’s fees and costs.
Carey and Golden are being represented by Richard Busch, who also represented Marvin Gaye’s family in the lawsuit over Robin Thicke’s “Blurred Lines.” Interestingly enough, the famed attorney also worked against Sheeran in a copyright infringement case involving his song “Photograph,” which ended in a settlement.
